The resolution sets out in a new version approved on September 8, 2016. The procedure for payment of remuneration to state performers and their size and amount of the basic remuneration of a private performer. The changes will take effect on January 1, 2022.
It is established that the payment of remuneration to state executors of the state executive service is carried out at the expense of the collected executive fee within and at the expense of the corresponding receipts to the special fund of the state budget on the basis of estimates and plans of allocations of the special fund for the corresponding year.
The following amounts of remuneration are determined:
to the state executor - 25% of the amount of the executive fee collected by him;
to the head of the department of the state executive service, the department of enforcement of management decisions - 3% of the amount of the executive fee collected by the relevant department;
Deputy Chief - 2% of the amount of the executive fee collected by the relevant department. If the chief has 2 deputies - 1% of the amount;
the chief, who ensured the direct execution of executive documents, is also paid 25% of the amount of the executive fee collected by him;
the head of the Department for Enforcement of Decisions of Interregional Departments of the Ministry of Justice - 1.5% of the amount of the executive fee collected by subordinate departments of the State Executive Service and the relevant department for enforcement of management decisions; deputy chief - 1% of the amount, if more than 1 deputy - 0.5% of the amount of the executive fee;
Director of the Department of the State Enforcement Service of the Ministry of Justice - 4% of the amount of the enforcement fee levied by the departments of enforcement of management decisions in the city of Kyiv and the department of enforcement of decisions of the department; to the deputy director - 2%;
Deputy Head of the Department for Enforcement of Decisions of the Department - 25% of the amount of the executive fee collected by him;
to the head of the Department for Enforcement of Decisions in the City of Kyiv of the Department of the State Enforcement Service of the Ministry of Justice - 1% of the amount of the enforcement fee levied by subordinate departments of the State Enforcement Service and the relevant department for enforcement of decisions in the city of Kyiv.
The amount of remuneration per month may not exceed 200 times the subsistence level for able-bodied persons, established on January 1 of the relevant year.
The amount of the basic remuneration of a private executor will be 10% of the amount collected by him or the value of the property to be transferred under the executive document.
According to executive documents on recovery of alimony in the presence of arrears of alimony, the total amount of which exceeds the amount of relevant payments for twelve months, the private executor accrues a basic fee of 10% of the amount of arrears of alimony in the manner prescribed by the Law of Ukraine who enforce court decisions and decisions of other bodies ”.
The amount of the basic remuneration of a private executor in case of execution of an executive document of non-property nature, according to which the debtor is an individual, is 4 subsistence minimum established on January 1 of the calendar year, and in case of execution of executive document of non-property nature, according to which the debtor is a legal entity - 8 sizes of the subsistence minimum established on January 1 of the calendar year.
