Automated seizure of bank accounts threatens all debtors, not just those who do not pay alimony.
The Ministry of Justice allowed public and private executors to impose automated seizure of debtors' funds on bank accounts.
The procedure for automated seizure of debtors' funds on bank accounts in enforcement proceedings for the recovery of alimony is set out in a new version by the order of the Ministry of Justice dated 23.03.2021 № 1061/5
From now on, the executors will seize the accounts not only of the alimony debtors, but also of all the others.
Automated seizure of debtors' funds in bank accounts provides:
obtaining information on debtors' accounts in banks;
imposition / removal by the executor of the seizure on / from the money (s) by making decisions on the seizure of funds and on the removal of the seizure from the debtor's funds in the form of an electronic document;
acceptance of them for execution by banks.
In order to seize a bank account on its own, the executor must first send a request to the bank for information about the account. We wrote in detail about the procedure for sending the request earlier.
